Terms of Sale

These terms of sale (the “Terms of Sale”) govern sales concluded, through the La Bonne Cueillette Service, between a shopper and a producer. The Publisher's legal notice (identity, hosting, mediation) is available on the dedicated “Legal notice” page.
1. Scope
The Terms of Sale apply to any order placed via the Service. They are supplemented by each producer's own terms, the producer remaining the seller. In case of conflict, mandatory consumer-protection rules prevail.
2. The platform's role
La Bonne Cueillette provides the technical tool for matchmaking, ordering and online payment. The sale is concluded between the shopper and the producer; the platform is not the seller of the products.
3. Products and availability
Products, their characteristics, prices and availability are described by each producer. Offers are valid while visible in the Service and within the limits of available stock and arrivals.
4. Ordering
The shopper selects products, chooses a pickup slot and confirms the order. The summary shown before confirmation prevails. The order is confirmed after the producer accepts it; a summary is made available in the Service.
5. Prices
Prices are shown in euros, all taxes included. The order total is computed server-side and prevails. The producer remains responsible for the VAT applicable to their products.
6. Payment
Online payment is securely processed by our provider Stripe (Stripe Connect). Some producers may offer on-site payment at pickup.
A platform commission may be charged on online sales; it is specified in the producer terms. Payouts are made to the farm's account via Stripe.
7. Order pickup (Click & Collect)
Products are collected (Click & Collect) at the farm or the point indicated by the producer, according to the chosen slot. The shopper agrees to show up within the slot; otherwise the producer may dispose of uncollected products, in particular perishable goods.
8. Right of withdrawal
Under article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods liable to deteriorate or expire quickly (perishable foodstuffs) or to goods made to the consumer's specifications.
For non-excluded products and where distance selling applies, the consumer has a legal period of fourteen (14) days to exercise their right of withdrawal with the relevant producer.
9. Conformity, complaints and warranties
The producer is bound by the legal warranties of conformity and against hidden defects under the conditions provided by law. Any complaint about an order must be addressed first to the producer, via the Service's messaging.
10. Liability
The producer is solely responsible for the quality, conformity, storage and handover of the products. The platform cannot be held liable for disputes regarding performance of the sale between shopper and producer.
11. Force majeure
A party's liability cannot be engaged for non-performance due to force majeure within the meaning of article 1218 of the French Civil Code and French case law.
12. Disputes and mediation
In case of dispute, the consumer first sends a written complaint. Failing a solution, they may use, free of charge, the consumer mediator indicated in the legal notice above. French law applies.
